Terms and conditions of sale relating to the sites, events, products and services marketed by Lem srl


Online sales are subject to the provisions of Legislative Decree no. 185 of 22 May 1999 "Implementation of Directive 97/7/EC relating to consumer protection regarding distance contracts"

1. Subjects. Service provider: LEM srlPiazza San Rocco 13 - 28921 Verbania (VB) - Italy - hereinafter LEM which can avail itself of external suppliers for operational support in the management of orders and payments. For services provided by third parties LEM acts as an engine of booking and intermediary for the services provided and is not a party to the agreements between the guest and the service provider, and has no responsibility or implication towards the user regarding compliance with the terms of the contract. Terms and conditions of sale refer in any case to all types of tickets and/or services booked on the site, whether the service is provided directly by LEM or by other suppliers indicated on the site itself on the service description page. Customer: the person identified by the data entered at the time of the online purchase request and in this regard the guarantees referred to in the following article 6 apply.

2. Object of the service. Booking service for live events and online products and services. The purchase takes place by entering your personal data online and making the payment by credit card (gateway stripe.com), PayPal - online bank transfer (Sofort). The payment method via offline bank transfer may also be available. Payment by bank transfer may not be available for particular promotions or close to the event itself.

The customer checks the availability of places, products or services online, enters their data and reservation and receives a summary email of the data entered, requesting them to complete the payment. Confirmation of the booking or purchase can be immediate or deferred. The reservation (or purchase) is confirmed only upon payment: the electronic booking ticket is created once payment has been made and automatically sent to the customer's email if payment is made by credit card or PayPal - in case of payment by bank transfer, the electronic booking confirmation ticket is sent to the customer's email as soon as the amount is credited to the current account indicated by the supplier.

To be sure of the booking, you will therefore need to wait for the confirmation email with the summary of the data, the CONFIRMED booking number and the BARCODE of the booking ticket.

For online products or services, delivery may be deferred, for example due to the time required to create customized products.

If the customer does not proceed with the payment, the reservation will be canceled and the customer will receive an email notifying him of the cancellation and will therefore have to make a new reservation or purchase, if the seats or products and services are still available.


Once the booking is confirmed, no refunds will be given and no complaints will be accepted due to errors made by the Customer in the phase of entering and/or communicating data relating to the order. On the occasion of particular promotions specified on the site, "refundable" tickets may be activated: to obtain a refund it is necessary to document the objective impossibility of participating in the event by means of a medical certificate or other official documentation.


These additional refund guarantees can be purchased at the time of booking and include an excess of 2.50 euros per ticket.

In the case of booking live events, if the event is canceled due to regulatory provisions, ordinances or otherwise (for example due to health emergencies linked to the Covid-19 epidemic), a voucher will be issued with a value equal to the booking made, valid 365 days for all events organized directly by Lem srl - Vouchers cannot be used for activities or services managed by third parties, for example for catering, transport, rides or anything else.


By purchasing the flexible date option, to be made exclusively at the time of booking, the customer can change the booked date and time up to 8 days in advance free of charge. Simply send an email to info@grottadibabbonatale.it choosing another date from those currently available. In the case of dynamically priced tickets, if the cost of the ticket is higher with the change, the customer will have to pay the difference; if the price is lower, there will be no refund of the price difference.

If no date is available, the customer can request a voucher for an amount equal to the value of the tickets purchased, valid for 365 days for all our events.

If the travel request occurs between 8 and 3 days prior, the change can be made at a cost of €5.00 per booking for digital products or services at a unit price (not per person) - if the change instead concerns events with booking and cost "per person" the change can be applied at a cost of €3.00 per person. It is not possible to request a change to the booking date within 48 hours before the booked date.


In live events, the reservation must be presented at the BOOK CHECKS appropriately indicated on the site with the indication BOOK CHECK. The booking and purchase refers solely to the Lem srl attractions specified on the site as included in the ticket, at the time of booking, on the date and time booked: any free gifts and promotions reserved for ticket holders will be indicated on the site and not they are binding for the organization nor are they to be considered included in the ticket. If the customer forgets the electronic ticket on the day of the event, they can still communicate the booking number or their name to the ticket office, accompanied by an identity document, to carry out the search in the service provider's databases. LEM is not responsible if the customer forgets it is not possible to trace the booking number. When the reservation is presented to the Booking Office and the ticket is delivered, the check-in will be recorded in the system and the visitor will not be able to carry out subsequent check-ins with the same reservation as it has already been used. No replacement tickets or passes will be delivered if the customer loses them once the reservation has been delivered and the tickets have been collected.


To facilitate access to the live event areas, the visitor can also make use of connection services, shuttles, trains, motorboats, buses etc. managed by leading transport companies: LEM offers - if provided - the transport booking service, the provision of the service is under the responsibility of the transport company - At the sole discretion of the organization the transport service may be canceled (due to causes of force majeure, traffic problems, insufficient number of booked passengers etc...), subject to prior communication to the customer, with at least 48 hours' notice. in this case the customer will have the right to withdraw from the booking with reimbursement of all expenses incurred for the live event, or may request to move the booking, without any increase in costs. By accepting these conditions, the customer expressly releases LEM from any and all liability and/or request for compensation following damage to people or things, accidents, misunderstandings, delays, missed connections, loss of objects following the use of the transport services booked and/or used, as well as for damages, injuries or thefts to people, things, vehicles during the event, in all areas with free access or access restricted to possession of the ticket. With regards to travel in the event area, with the acceptance of this document the customer declares to be informed of the obligation to observe the highway code and expressly relieves LEM from any and all liability and/or request for compensation following damage to people or things, accidents, loss of objects and any other inconvenience that may occur in the public or private areas affected by the event and in the related structures. Any medical assistance, recovery, hospitalization, first aid, medication, hospitalization or other interventions, if not covered by the NHS, are entirely at the customer's expense. If the event involves the presence of animals, the customer declares to be informed that it is forbidden to approach, touch or feed the animals and expressly relieves LEM of any and all liability. Those responsible and contact persons for the detention and management of the animal area are indicated on site.


By accepting these conditions, the buyer also expressly declares that the participation of any minors will take place solely under the supervision and responsibility of parents, guardians or responsible companions. LEM is in no case responsible for the services provided by third parties present in the live events, catering services, commercial areas and related commercial points, transport by tourist train, attractions and amusement parks and any and all activities, animation, demonstration, workshop, show not expressly attributable to the attractions managed by LEM. These services are not included in the ticket and will eventually be purchased directly by the customer from the respective suppliers. When completing forms, webforms, questionnaires, surveys, gaming or otherwise, LEM may randomly and at its sole discretion reward users with discounts, products or services, not aimed at encouraging the purchase or objects of minimal value. For gaming activities, LEM will make use of special platforms set up for this purpose, both for registration and participation, and for drawing and winning, without direct control of the drawing or winning activities which will therefore be completely random and entrusted to electronic methods.


3. Prices. Unless otherwise indicated in writing, all prices indicated are "VAT included", where due. An additional cost for online booking services of €1.50 per ticket is applied to online tickets which also include a live part. In the case of dynamically priced tickets, the cost of the ticket may vary based on the booking date, the date booked, the time slot and the number of people booked.

4. Payment. Payment is made by credit card (Visa, Mastercard, PostePay or Carta Aura) through Stripe's online payment gateway with 128 bit encryption system, Stripe-Sofort or via PayPal. The payment gateway is managed by Stripe .com (or PayPal). LEM is not aware of the customer's credit card number. The Customer is informed that the online payment is completed only after, following confirmation of the order by the Customer, the Electronic Money Institute (IME) releases consent to the use of the credit card. In the case of payment by bank transfer, payment is considered completed only once the transfer has been credited to the Supplier's account. The customer can send a copy of the bank transfer in advance by e-mail (lemsegreteria@gmail.com) or by fax to 0323-497349 - highlighting the CRO number. Summary diagram: Phase 1: order submission by the Customer; Step 2: request for Card authorization from Stripe (or PayPal) - or credit the bank transfer made by the customer to the Supplier's account. Phase 3: forwarding the requested product or service to the Customer. Phase 4: presentation of the electronic booking ticket to the Booked Ticket Office on the day of the booked event (and/or to the driver if the ticket also includes transport) - collection of entry passes and access to the booked service (attractions included in the ticket as specified on the booking site). The negative response in Phase 2 will result in the order being blocked. The Customer is informed of the fact that the order and the related payment will be collected by LEM through its information system and - for products or services not supplied directly by LEM - transmitted to the Service Provider. The organizer and the supplier respond directly to the customer for the conformity of the service provided with what is illustrated on the service description page.5. Freebies: online booking may include freebies that are given to the customer by the organization or third parties. In events where the complimentary photo is foreseen, it cannot be combined: therefore it is not possible to request multiple photographs representing the same subjects, or for groups of people in which even just one subject has already been portrayed in other complimentary photographs or for bookings attributable to the same one person, whether they use the same name, with a different email, or different names with different emails, but entered from the same PC, unequivocally identified at the time of booking through the automatic registration of the user's IP. Therefore, if a single booking is artificially divided into multiple bookings for the purposes of the free gift, the bookings identified by the same IP will be unequivocally considered a single booking. Larger groups of users will be entitled to one free photo for every 8 people. The complimentary photo is excluded for bookings of a single person. Participants in our events may also be granted discount vouchers, to encourage and promote the purchase of services or activities managed directly by Lem srl or by third parties: on these third-party activities Lem srl has no direct responsibility with regards to liability, mandatory tariffs or other constraints that those who provide the services purchased at a discounted price by Lem srl customers must comply with. 6. Right of withdrawal. The withdrawal regulations provided for in articles. 64-67 of Legislative Decree 206/2005 (so-called Consumer Code) relating to the rules aimed at protecting consumers in the event of contracts negotiated away from commercial premises or stipulated remotely, is excluded for Proposals concerning services relating to accommodation, transport, catering and leisure pursuant to art. 55 of the same decree: "Art. 55. Exclusions 1. The right of withdrawal provided for in articles 64 et seq., as well as articles 52 and 53 and paragraph 1 of article 54 do not apply: (omissis) b) to contracts of provision of services relating to accommodation, transport, catering, leisure, when at the time of the conclusion of the contract the professional undertakes to provide these services on a specific date or in a pre-established period."


The live events will take place in any weather condition: due to causes of force majeure, explicit requirements by public authorities and/or surveillance and control or particular adverse weather conditions and at the sole discretion of the organization the location of the event may also be moved without notice in another location, always in the same location, in order to still allow the program to take place. The booking times for live entrances, where applicable, may undergo variations due to the influx of visitors or other organizational or logistical causes: in the event of delays, the organization undertakes to extend entrances to the event beyond the established time, so as to allow everyone to access the visit.

However, if a date is canceled by the organizers due to reasons of force majeure which prevent the event from being held in the event of bad weather or for other causes - other than cancellation for health reasons linked to the Covid epidemic (in this case, as specified above, the fee paid for the live part of the events will be refunded via voucher) - the customer will be issued a voucher equal to the amount paid for the live event, to book the visit on another date, for other events organized by LEM srl or for the subsequent edition, if there are no available dates or the customer opts for this solution.


7. Guarantees provided by the Customer. The Customer guarantees, assuming all inherent responsibility and holding LEM, as an intermediary, harmless from any prejudicial consequences, that their data, provided upon acceptance of these general conditions, are truthful and allow the Customer's true identity to be identified himself who also undertakes to immediately inform the Supplier in written form, including by e-mail, of any change in the data provided.8. Limitations of Liability. Any information relating to the products sold by the Supplier is based exclusively on the data published and made known by the respective producers. LEM does not assume any direct, indirect or consequential responsibility in relation to the data provided by the producers or service providers, as well as for injuries, theft or damage suffered by the customer during the visit or in the event areas.9. Communications. The Customer accepts that the notification and communications relating to all online services are carried out by the Supplier in electronic e-mail format (electronic mail), recognizes their full validity and expressly renounces as of now to deny the content of the declarations sent and/or or received in electronic format. The Customer is informed and accepts that LEM keeps archives of the technical Log Files on its systems relating to the traceability of online operations, as well as all the activities carried out on the managed booking sites and recognizes their validity for the purpose of possible reconstruction of the relationships established. The customer expressly authorizes LEM to process personal data for all operations connected to online sales, the processing or customization of online products or services (for example photos, including those of minors, for personalized videos or recording files of video calling services via zoom or other software for which please refer to the relevant privacy regulations) for information on the activities managed by LEM or its partners directly or as an intermediary for communication and booking services, also by sending newsletters and information messages via mobile telephone, regular mail, or other media.10. Applicable law. For all ONLINE SALES services, the law of the Italian State applies exclusively.11.
